Home Rent Rules 2025 : Security Deposit Capped, Rent Hikes Regulated & Leases Standardized

Home Rent Rules 2025 : India’s rental housing market has seen a significant shift in 2025. The new Home Rent Rules focus on establishing a fair, transparent, and balanced system for both tenants and landlords. These changes are intent on limiting disputes, regulating the amount of rent increase and making agreements simpler throughout the country.

Standard Rental Leases Now Required

All rental contracts must now have a government set format. This includes clear terms on rent, security deposit, maintenance, and notice periods. Agreements should be registered in digital format within 60 days, so that they acquire legal validity and reduce cases of fraud.

New Limit on the Security Deposit

Landlords can now only request a security deposit of up to two months’ rent. This rule makes it easier for tenants to pay less and be able to afford a move.

Controlled Rent Hikes

Rent can only be raised once a year. Landlords are required to provide written notice of any increase for 90 days prior. The percentage increase should match with inflation and be reasonable to avoid shock to tenants’ finances.

Faster Dispute Resolution

Special rental courts have been set up to dispose of disputes expeditiously. These courts aim to resolve cases such as eviction, damage claims, and deposit issues within 60 days, providing a quicker path to justice and peace of mind.

Digital Payments and Clarity about Taxes

Transactions in rent above Rs 5,000 must be done digitally. Rental income is now considered to be “income from housing property” under S 28 of the Income Tax Act. The TDS exemption limit has been increased from Rs 2.4 lakh per year to Rs 6 lakh per year, thereby making it easier for the landlords to manage cash flow.
